{"id":625,"date":"2014-12-19T10:30:40","date_gmt":"2014-12-19T10:30:40","guid":{"rendered":"https:\/\/grtconsultants.com\/new\/?p=625"},"modified":"2015-02-13T13:34:31","modified_gmt":"2015-02-13T13:34:31","slug":"dft-publishes-hgv-testing-operator-licencing-consultations","status":"publish","type":"post","link":"https:\/\/grtconsultants.com\/new\/dft-publishes-hgv-testing-operator-licencing-consultations\/","title":{"rendered":"DfT Publishes HGV Testing &#038; Operator Licencing Consultations"},"content":{"rendered":"<p>The Department for Transport (DfT) has published two public consultations which propose to alter and tighten legislation relating to <a href=\"https:\/\/www.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/386447\/HGV_Periodic_Testing_and_Inspections_Exemptions.pdf\" target=\"_blank\">HGV testing<\/a> and <a href=\"https:\/\/www.gov.uk\/government\/uploads\/system\/uploads\/attachment_data\/file\/385957\/Goods_Vehicle_Operator_Licensing_Exemptions_Consultation.pdf\" target=\"_blank\">goods vehicle operator licencing<\/a>.<\/p>\n<p>Firstly, the consultation on HGV testing proposes to remove nine and modify one of the exemptions in Schedule 2 to the <a href=\"http:\/\/www.legislation.gov.uk\/uksi\/1988\/1478\/contents\/made\" target=\"_blank\">Goods Vehicles (Plating &amp; Testing) Regulations 1988<\/a>. Amongst those categories being considered for removal are:<!--more--><\/p>\n<ul>\n<li>Mobile cranes<\/li>\n<li>Break-down vehicles<\/li>\n<li>Engineering plant<\/li>\n<li>Trailers, being drying or mixing plant, designed for the production of asphalt, bituminous or tarmacadam<\/li>\n<li>Tower wagons<\/li>\n<li>Road Construction Vehicles (not road rollers or other specialised equipment used in the road construction process)<\/li>\n<li>Electrically propelled motor vehicles<\/li>\n<li>Vehicles constructed or adapted for, and used primarily for the purpose of medical, dental, veterinary, health, educational, display, clerical or experimental laboratory services<\/li>\n<li>Tractor units pulling exempt trailers<\/li>\n<\/ul>\n<p>The categories\u00a0being considered for modification are:<\/p>\n<ul>\n<li>Vehicles having a base or centre in any of the following islands, namely\u00a0Arran, Bute, Great Cumbrae, Islay, Mull, Tiree or North\u00a0Uist from which use of the vehicle on a journey is normally\u00a0commenced<\/li>\n<\/ul>\n<p>The reason for this review is due to the fact that the number of exempt vehicles is growing which in turn causes concerns about road safety. There have also been <a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=uriserv:OJ.L_.2014.127.01.0129.01.ENG\" target=\"_blank\">changes at European Union level<\/a> which have subsequently caused compatibility issues with the exemptions that UK legislation currently allows.<\/p>\n<p>Secondly, the consultation on operator licencing focuses mainly on bringing engineering plant into scope of the legislation; however, four other categories are also under consideration including:<\/p>\n<ul>\n<li>Recovery and break-down vehicles<\/li>\n<li>Showman&#8217;s vehicles<\/li>\n<li>Mobile cranes<\/li>\n<li>Electrically operated vehicles<\/li>\n<\/ul>\n<p>Again, the main reason for these proposals surrounds road safety. As most of these vehicles are based on a normal HGV chassis, and bearing in mind the proposals to bring most of these vehicles into the scope of Plating &amp; Testing regulation, it is thought that there would be very little difference between these vehicles and other HGV\u2019s governed by operator licencing legislation.<\/p>\n<p>Both consultations remain open until 5th March 2015.
